Is This Legal?

FUNNY CASH COW received a letter from the Department of the Treasury, Bureau of Engraving and Printing dated November 2011. This letter included the definition and statutes regarding the defacement of currency.

The letter reads “Currency notes bearing the portraits of well-known personalities (such as Santa Claus, Jesus Christ and movie stars) are for the most part found to be genuine United States currency. Private businesses produce these novelty items by purchasing new currency notes from banks and subsequently apply the picture of the well known personality over the engraved portrait on the bill by means of a pressure-sensitive adhesive. These businesses then charge their customers premium prices.

The United States Secret Service maintains currency regulations dealing with defacing, reproducing, counterfeiting, etc. They have determined that this practice does not violate federal statutes as long as the paste-on photograph can be removed without damaging the original note.

The legality is also shown in a letter from Thomas J. Kelley, Assistant Director, Treasury Department, dated July 19, 1967. In the letter it stated, “Based on our investigation of the matter, it is the opinion of this office, in which the Office of the General Counsel concurs, that such action is not prohibited by any existing Federal statute … the practice of superimposing pictures of famous persons on $1 Silver Certificates or $1 bills is not considered an advertisement or notice within the meaning of section 475, due to the fact that they are manufactured as, and intended to be, novelties.”

“As long as the photo can be removed, what you are doing is legal. But I must warn you there are strict laws about copying and counterfeiting. In your advertising to illustrate your bills, any reproduction must be enlarged at least 150% or reduced 75%.”
